Agreement
These terms apply when a pickleball club (an "organiser") signs up to use Pickley, and to anyone using the free Quick Draw tool at pickley.app/social. Pickley is contactable at hello@pickley.app. By creating an organiser account, generating a draw, or otherwise using Pickley, you agree to these terms on behalf of yourself or the club you represent.
What Pickley is
Pickley is software for running pickleball club nights: session draws, scoring, leaderboards, and tournaments. There's a free tier (the Quick Draw tool, usable without an account) and a paid club subscription (Competitive Draw) for clubs that want scoring, unlimited players, and a shared cloud roster. Some clubs run on custom, standalone builds of Pickley rather than the general signup product; where that's the case, a separate arrangement with that club may apply instead of the standard pricing below.
Accounts and who's responsible for what
An organiser account is created and controlled by whoever signs the club up, usually a committee member or club administrator. That person is responsible for keeping login details secure and for what happens under their account, including player names and scores entered into the app. Players themselves don't create accounts or agree to these terms directly, since Pickley is software the club uses on their behalf, not a service players sign up for individually.
It's the organiser's responsibility to have their club's permission to run sessions through Pickley and to enter player information, the same as it would be for a paper sign-in sheet or a whiteboard draw. See the Privacy Policy for how that information is handled.
Pricing and billing
The Quick Draw tool is free, with no account or payment details required. Eligible new clubs may start one 30-day free trial of the Club subscription. No payment method is required to begin the trial, and no charge is made during it. The trial starts when Stripe confirms the signup and ends on the date shown on the confirmation page and in Stripe's emails.
Before the trial ends, Stripe will email the organiser a secure Stripe-hosted link where they can add a payment method. Adding a payment method before expiry authorises the Club subscription to begin automatically at $49 NZD per month, GST included, when the trial ends. If no payment method is added, Stripe pauses the subscription at the end of the trial. The paused subscription and club data remain in place and Pickley does not automatically delete them because the trial has ended, but new paid-session generation is disabled. The recorded billing contact can later use Pickley's secure emailed link to open Stripe, select Start subscription, add a payment method, and pay the first $49 NZD monthly invoice. Successful payment resumes the same subscription and restores new paid-session generation. A club can end its trial or subscription by emailing hello@pickley.app. If a payment fails after conversion, Pickley may allow a reasonable retry period before paid-session generation is disabled. Except where required by law, charges already made are not refundable.
Acceptable use
Pickley is meant to be used for running real pickleball sessions. Please don't use it to store information unrelated to running a club night, attempt to disrupt or overload the service, try to access another club's data, or resell or sublicense access to Pickley without agreement. The free tier's player cap and local-only storage exist to keep the free tool sustainable; please don't try to circumvent them at scale.
Availability
Pickley is currently run and maintained by a single developer, and there's no guaranteed uptime or service level. Every reasonable effort is made to keep the app available for club nights, including during live sessions, but outages can happen. If Pickley is unavailable during a session, we'd suggest falling back to a manual draw for that night; we're not liable for any loss arising from downtime beyond refunding the affected subscription period on request.
Data and content
Player names, scores, and session data entered into Pickley belong to the club that entered them. Pickley doesn't claim ownership of that data and won't use it for anything beyond providing the service, as described in the Privacy Policy. If a club stops using Pickley, we'll delete their data within a reasonable time on request.
Changes and cancellation
We may update these terms or the service itself from time to time. If a change materially affects a paying club, we'll email the organiser before it takes effect. Either side can end the arrangement at any time: an organiser can cancel a subscription by emailing us, and we may suspend or close an account for non-payment, misuse, or if a club is no longer active.
Liability
Pickley is provided as is, without warranties beyond what New Zealand law requires. To the extent the law allows, our liability for any claim relating to Pickley is limited to the amount your club paid in the twelve months before the claim, and we're not liable for indirect or consequential losses. Nothing here limits any rights you have under the Consumer Guarantees Act or Fair Trading Act that can't legally be excluded.
Governing law
These terms are governed by the laws of New Zealand, and any dispute will be handled in New Zealand courts.
